A comprehensive bill is intended to align the Danish Natural Gas Supply Act with the EU\u2019s new rules on hydrogen and renewable gases. Among other things, the proposal introduces new requirements for hydrogen infrastructure, market access, corporate unbundling and regulation of the gas grid. The changes could have significant implications for investments in hydrogen production, transport and storage. <\/em><\/p>\n

On 7 October 2026, the Minister for Climate, Energy and Utilities tabled bill L 14 to amend the Natural Gas Supply Act.<\/p>\n

The bill is intended to implement parts of the EU hydrogen and gas market package, consisting of Directive (EU) 2024\/1788 and Regulation (EU) 2024\/1789.<\/p>\n

The purpose is to develop a common European market for renewable and low-carbon gases, including hydrogen, while also adapting the regulation of the existing natural gas system to the green transition.<\/p>\n

Separate regulation of hydrogen infrastructure<\/h3>\n

A key change is the introduction of a clearer regulatory distinction between the methane gas system and the hydrogen system.<\/p>\n

The bill introduces a number of new definitions, including hydrogen transmission networks, hydrogen distribution networks, hydrogen storage facilities and hydrogen terminals.<\/p>\n

The rules are intended to ensure that hydrogen infrastructure can be developed within a framework that takes account of the differences between the existing gas markets and a future hydrogen market.<\/p>\n

The bill also provides for the Danish Utility Regulator (Forsyningstilsynet) to grant exemptions from certain regulatory requirements for geographically delimited hydrogen networks, for example networks within an industrial area.<\/p>\n

Such an exemption is subject, among other things, to competition and the development of the overall hydrogen market not being adversely affected.<\/p>\n

Requirements for unbundling and regulated access<\/h3>\n

The bill also introduces rules on corporate unbundling between hydrogen activities and other regulated energy activities. The purpose is in particular to create transparency regarding financing and tariffs and to prevent unintended cross-subsidisation between gas, electricity and hydrogen activities. <\/p>\n

For transmission undertakings that form part of groups with gas or electricity infrastructure, hydrogen activities will, as a general rule, have to be organised in separate companies, albeit with the possibility of an exemption subject to specific conditions.<\/p>\n

The bill also introduces rules on regulated third-party access to hydrogen storage. Denmark does not propose to use the temporary EU-law option to defer the transition to regulated access until the end of 2032. <\/p>\n

At the same time, the Danish Utility Regulator (Forsyningstilsynet) is given a strengthened role in regulating hydrogen infrastructure, including by approving methodologies for setting tariffs and access conditions.<\/p>\n

Conversion and possible decommissioning of the gas grid<\/h3>\n

The bill does not concern hydrogen alone. It also contains rules intended to enable a gradual adaptation of the existing methane gas grid in step with an expected decline in the consumption of fossil gas. <\/p>\n

This includes a proposal to allow parts of the gas distribution system to be decommissioned if continued operation is no longer economically viable for the company. At the same time, rules are introduced to protect affected customers, including particularly vulnerable consumers. The bill also aims to strengthen requirements for long-term system planning. Relevant gas and hydrogen operators must prepare development plans with a ten-year time horizon. <\/p>\n

Implications for hydrogen projects and investors<\/h3>\n

The bill is a significant step towards establishing a properly regulated hydrogen market in Denmark.<\/p>\n

For developers and investors in hydrogen projects, the rules on grid connection, third-party access, tariffs and corporate unbundling may in particular affect the projects\u2019 structuring and financial assumptions. The regulation may provide greater predictability, but also new requirements for organisation, documentation and regulatory approvals. <\/p>\n

At the same time, companies with long-term investments in natural gas infrastructure, or a dependency on gas supply, should be aware of the new rules on conversion and the possible decommissioning of parts of the gas grid.<\/p>\n

As a general rule, the bill is expected to enter into force on 1 January 2027, albeit with a separate commencement provision for a specific provision.<\/p>\n

The specific implications for individual hydrogen projects will, among other things, depend on subsequent regulatory measures and the terms laid down for access to and use of the infrastructure.<\/p>\n
